Banking & Finance

In our experience, we have assisted banking and financial institutions, such as banks and asset management companies.

In particular, we have experience in litigation related to banking contracts (i.e. anatocism, usury, etc.), credit recovery and in the formulation of legal opinions on the subject.

We also have experience in financial litigation, with particular regard to the liability of financial promoters and in all the stages of sanction proceedings brought by the supervisory authorities (i.e. insider trading, market manipulation ecc.).

Bankruptcy, restructuring and insolvency

We have experience in corporate crisis and debt restructuring. We deal with all aspects of company restructuring and insolvency law.

In the course of our career, we have developed experience as bankruptcy trustees.

We have also represented bankruptcy trustees, court commissioners and extraordinary administrators appointed in insolvency proceedings.  We have provided advice during the various stages, including the implementation of the restructuring or liquidation plan, the possible subsequent sale, the assessment of debts, the defence in the case of litigation.

We have assisted investors and creditors in relation to debt restructuring, utilizing the various tools provided by the Italian bankruptcy law. The investors and creditors are advised throughout the entire legal procedure.

Commercial contracts

We can assist you in drafting and reviewing different types of contracts pertaining to your business. Our experience with foreign and Italian clients operating abroad has enabled us to gain significant background in international commercial law and to deal with problems pertaining to applicable law and the competent forum for the resolution of any disputes.

We assist clients at the negotiation stage with their business partners so that they can sign contractual clauses tailored to their specific business needs. More specifically, we work to reduce issues related to the abuse of economic dependence, compliance with consumer codes and sub-contracting regulations. Moreover, we study possible solutions and contractual remedies to avoid any risk related to possible insolvency proceedings by counterparties.

Competition & IP

We offer a range of services for protecting intellectual property (IP) across borders, and for resolving IP disputes inside and outside the courts. We have also developed strong expertise in competition disputes, and we are now able to assist companies involved in these kinds of issues.

We also assist directors and shareholders in litigation matters related for example to directors’ and auditors’ responsibilities. Insurance

We are able to provide specific assistance and support in insurance services, including commercial disputes and claims.

In our experience, we have assisted Italian insurance companies, Italian branches of insurance companies located in foreign countries and European insurers acting on a freedom of service basis.

In particular, we have developed a vast knowledge in insurance litigation involving life policies, unit-linked policies and liability policies.

Litigation and Arbitration

We offer an broad array of services in litigation, arbitration and alternative dispute resolution, with a special focus on insurance, banking, real estate, third party liability, m&a, credit recovery, bankruptcy and labour law.

Procurement

Our team provides cross-border and domestic advice to clients on public procurement and competitive tendering rules. In this regard our team is mainly focused on the issues and disputes involving contractors and subcontractors for breach of contract.
